1. Definitions

• "Nestwell" / "we" / "us" / "our" — the entity operating educational information services at 46, Jalan Telawi 3, Bangsar Baru, 59100 Kuala Lumpur, Malaysia.
• "You" / "participant" / "user" — any individual accessing this website or booking a session.
• "Services" — educational information sessions, workshops, and programmes offered by Nestwell, as described on this website.
• "Session" — any individual or group educational event, including the Understanding Your Statements Session, Document Sorting & Filing Workshop, and Retirement Information & Organisation Programme.
• "Materials" — annotated example sheets, filing templates, checklists, binders, and any other printed or digital resources provided by Nestwell.
• "Agreement" — these Terms & Conditions together with our Privacy Policy and Cookie Policy.

2. Acceptance of Terms

By submitting an enquiry form, making a booking, or attending a session, you confirm that:

• You are at least 18 years of age
• You have the legal capacity to enter into this agreement
• You accept these terms in full

3. Description of Services

Nestwell provides general educational information sessions and document organisation workshops. Our services are limited to:

• Plain-language explanation of how typical retirement account statements are structured
• Practical guidance on organising personal retirement paperwork
• General information about the stages of retirement administration in Malaysia
• Assistance preparing questions for official bodies such as EPF or pension administrators

Sessions are held in Kuala Lumpur. Availability is subject to scheduling. We reserve the right to reschedule or cancel sessions where necessary; participants will be notified promptly and offered an alternative date or a full refund.

4. Booking and Payment

• Bookings are confirmed upon receipt of payment and a confirmation email from Nestwell.
• Fees are listed in Malaysian Ringgit (RM) and are inclusive of all session materials unless otherwise stated.
• Payment terms and accepted methods will be communicated at the time of booking confirmation.
• Fees are non-refundable unless Nestwell cancels or reschedules the session, or unless the participant provides at least 5 business days' written notice of cancellation prior to the session date.
• Cancellations with less than 5 business days' notice may be offered a credit towards a future session at Nestwell's discretion.

5. Participant Responsibilities

When attending sessions or using this website, you agree to:

• Treat facilitators and other participants respectfully
• Provide accurate information when booking or making enquiries
• Not record sessions without prior written consent from Nestwell
• Not reproduce, sell, or distribute Nestwell's materials without written permission
• Use this website only for lawful, personal purposes

6. Intellectual Property

All content on this website and all materials provided in sessions — including annotated example sheets, filing templates, checklists, and programme materials — are the intellectual property of Nestwell. You are granted a personal, non-transferable licence to use these materials for your own record-keeping and educational purposes. You may not reproduce, distribute, or sell them without our prior written consent.

7. Disclaimers

• All sessions and materials are provided for general educational purposes only. They do not constitute financial, investment, tax, or legal advice.
• We make no representations about the accuracy of information as it applies to any individual's personal retirement accounts or circumstances.
• We do not warrant that the website will be uninterrupted or error-free.
• Example materials used in sessions are illustrative only and may not reflect the exact format of any particular institution's statements.

8. Limitation of Liability

To the fullest extent permitted by Malaysian law, Nestwell's total liability to you in connection with any session or use of this website shall not exceed the fee paid by you for the relevant session. We are not liable for indirect, consequential, or incidental loss arising from your use of our services or your reliance on our materials.

9. Indemnification

You agree to indemnify and hold Nestwell, its staff, and representatives harmless from any claims, losses, or expenses arising from your breach of these terms or your misuse of our services or materials.

10. Termination

Nestwell reserves the right to refuse or terminate access to sessions or this website where there is reason to believe these terms have been breached. You may cease using our services at any time subject to the cancellation terms in Section 4.

11. Governing Law & Dispute Resolution

These terms are governed by the laws of Malaysia. Any dispute arising from these terms or your use of our services shall first be addressed through informal discussion. If unresolved within 30 days, disputes shall be referred to the courts of Malaysia in the jurisdiction of Kuala Lumpur.

For minor disputes, you may also contact the Tribunal for Consumer Claims Malaysia.

12. Changes to These Terms

We may update these terms periodically. The revised version will be posted here with an updated date. Continued use of the website or attendance at sessions after changes are posted constitutes acceptance of the revised terms.
